Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the MDM Stoneworks website and the purchase of any products or services from MDM Stoneworks, Inc. ("MDM Stoneworks," "we," "our," or "us"). By accessing our website or placing an order, you agree to be bound by these Terms.

1. Order Acceptance

Submitting an order does not constitute acceptance by MDM Stoneworks.

All orders are subject to review and acceptance. We reserve the right to refuse, cancel, or limit any order for any lawful reason, including pricing errors, inventory shortages, suspected fraud, or product availability.

An order is considered accepted when it has been processed by MDM Stoneworks or transmitted to the manufacturer, supplier, warehouse, or shipping carrier for fulfillment.

2. Product Availability

Many products are shipped directly from manufacturers or regional distribution centers.

Inventory availability, manufacturing schedules, and supplier allocations may change without notice.

We reserve the right to substitute packaging or discontinue products without prior notice.

3. Pricing

Prices are subject to change without notice until an order has been accepted.

Although we strive for accuracy, pricing, product descriptions, shipping costs, and specifications may occasionally contain errors. We reserve the right to correct such errors and cancel or modify orders affected by those errors.

4. Lead Times

Any lead time shown on our website, quoted by our staff, or provided by a manufacturer is an estimate only.

Actual lead times may vary due to manufacturing schedules, inventory availability, freight delays, weather, labor shortages, material shortages, tariffs, or other circumstances beyond our control.

Estimated delivery dates are not guaranteed.

MDM Stoneworks shall not be liable for delays outside of our reasonable control.

5. Freight Shipments

Most products are delivered by Less-Than-Truckload (LTL) freight.

Customers are responsible for providing accurate delivery information and ensuring someone is available to receive freight deliveries when scheduled.

Additional carrier charges resulting from missed appointments, limited site access, residential delivery complications, storage, redelivery, rerouting, or detention are the responsibility of the customer.

6. Inspection Upon Delivery

Customers must inspect all shipments immediately upon delivery before signing the delivery receipt.

Visible damage, shortages, or incorrect materials must be noted on the carrier's delivery receipt at the time of delivery.

Concealed damage or shortages must be reported to MDM Stoneworks within forty-eight (48) hours of delivery.

Failure to properly inspect and report damage within this timeframe may affect our ability to assist with freight claims.

7. Order Cancellations

Because many products are ordered specifically for each customer and shipped directly from manufacturers, orders begin processing immediately after purchase.

Orders may only be canceled before processing begins.

Once an order has entered manufacturing, supplier fulfillment, warehouse processing, or has been tendered to a freight carrier, it cannot be canceled.

Customers requesting cancellation after processing begins remain responsible for all costs incurred, including:

  • Outbound freight

  • Return freight

  • Supplier restocking fees

  • Storage fees

  • Rerouting charges

  • Carrier fees

  • Any other non-recoverable fulfillment costs

Refusing delivery does not cancel an order.

8. Returns & Refunds

Returns are governed by our Refund, Return & Cancellation Policy, which is incorporated into these Terms by reference.

By placing an order, customers acknowledge they have reviewed and accepted that policy.

9. Special Orders

Products identified as special-order, made-to-order, custom, or non-stock items cannot be canceled after production or procurement begins and are generally non-returnable unless defective.

10. Product Variations

Manufactured stone, natural stone, brick veneer, mortar, and other masonry products naturally vary in color, texture, size, shape, finish, and appearance.

Product photography is representative only.

Such variations are inherent characteristics of the products and do not constitute defects.

Customers are responsible for ordering sufficient quantities to complete a project, including recommended overage.

11. Installation

Customers are responsible for ensuring all products are appropriate for their intended application.

Installation must follow manufacturer instructions and applicable building codes.

MDM Stoneworks is not responsible for improper installation, misuse, structural failures, improper substrate preparation, weather exposure during installation, or labor costs associated with replacement materials.

12. Limitation of Liability

To the fullest extent permitted by law, MDM Stoneworks shall not be liable for indirect, incidental, consequential, special, or punitive damages.

Our maximum liability for any claim shall not exceed the purchase price of the specific product giving rise to the claim.

MDM Stoneworks shall not be responsible for lost profits, project delays, labor costs, rental equipment, business interruption, or other consequential damages.

13. Payment Disputes & Chargebacks

Customers agree to contact MDM Stoneworks before initiating any payment dispute or chargeback.

Initiating a chargeback does not cancel an order, terminate a customer's contractual obligations, or eliminate responsibility for products that have entered fulfillment or shipment.

MDM Stoneworks reserves the right to submit all relevant documentation to payment processors and financial institutions, including but not limited to:

  • Order confirmations

  • Customer communications

  • Tracking information

  • Proof of delivery

  • Signed delivery receipts

  • Supplier invoices

  • Acceptance of these Terms

  • Acceptance of the Refund Policy

Customers remain responsible for all freight charges, restocking fees, supplier charges, and fulfillment costs incurred before any payment dispute.

14. Fraud Prevention

MDM Stoneworks reserves the right to verify customer identity, billing information, delivery information, or payment details before accepting an order.

Orders suspected of fraud may be delayed or canceled.

15. Force Majeure

MDM Stoneworks shall not be liable for delays or failures caused by events beyond our reasonable control, including but not limited to:

  • Weather

  • Natural disasters

  • Supplier shortages

  • Transportation disruptions

  • Labor strikes

  • Government actions

  • Tariffs

  • Public health emergencies

  • Power outages

  • Cybersecurity incidents

16. Intellectual Property

All website content, product descriptions, photographs, graphics, logos, and other materials are the property of MDM Stoneworks or its licensors and may not be copied or reproduced without written permission.

17. Governing Law

These Terms shall be governed by the laws of the State of Indiana, without regard to its conflict of law principles.

Any legal action arising out of these Terms or any purchase from MDM Stoneworks shall be brought exclusively in the state or federal courts located in Allen County, Indiana.

Customers consent to the exclusive jurisdiction of those courts.

18. Collection Costs

If MDM Stoneworks must pursue collection of unpaid amounts arising from an order, the customer agrees to pay all reasonable collection costs, including attorneys' fees, court costs, collection agency fees, and any interest permitted by applicable law.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. Changes to These Terms

MDM Stoneworks may update these Terms at any time without prior notice.

The version posted on our website at the time an order is placed shall govern that transaction.
